Is DUI a crime in New Jersey?


Driving under the influence is not a criminal offense in New Jersey. Instead, it is considered a traffic violation. This distinction means that individuals convicted of a DUI in New Jersey will not have a criminal record for the offense. However, this should not downplay the severity of a DUI conviction. A conviction can carry significant penalties, including, but not limited to, license suspension, fines, and even potential jail time. 

Can I be charged for DWI even if my BAC is below 0.08%?


You can be charged with DWI in New Jersey even if your blood alcohol content (BAC) is below 0.08%. You can be charged using other observational-type evidence without a particular BAC test result. 


For example, if a law enforcement officer determines that you are driving erratically or displaying signs of impairment, and there is evidence of alcohol or drug consumption, you can still face DUI charges.


The legal limit is also lower for commercial drivers (0.04%) and drivers under 21. New Jersey has a zero-tolerance policy for underage drinking. Drivers under the age of 21 can face penalties for any amount of alcohol in their system.

Can I defend myself for a DWI arrest in Gloucester County?
