Refusing a breath test when suspected of driving while intoxicated can lead to severe consequences. New Jersey, like every state, operates under the "implied consent" law. This law means that by having a New Jersey driver's license, you have already given consent to submit to a breath test if law enforcement suspects you of driving under the influence.
If you refuse a breath test, you will get a separate ticket and face refusal penalties. These penalties may be separate from those you face in a DWI conviction. Depending on the circumstances of the case, refusal penalties may include mandatory license suspension and installation of an ignition interlock device (IID). They may also include participation in an Intoxicated Driver Resource Centers program and fines.
If convicted of a DWI in Camden County, you cannot avoid license suspension. However, with aggressive representation on your side, reducing charges or even getting your charges dismissed is possible. Do not hesitate to discuss the charges against you in a free initial consultation. Our Camden County DUI attorney has successfully handled thousands of DWI cases across South Jersey and can fight for your best interests too.
In many states, first-time DUI offenders may be able to participate in diversion programs, such as substance abuse classes or community service, to keep their records clean of a DUI conviction. Unfortunately, New Jersey does not offer diversion programs for DUI offenders. However, that does not mean your case is hopeless and you do not have defense options. Discuss your charges with our experienced Camden County DWI lawyer today.
A DUI or DWI conviction in Camden County or anywhere else in New Jersey becomes a permanent part of your driving record. Unfortunately, it does not drop off your record. Additionally, you cannot expunge a DWI conviction in New Jersey.
In New Jersey, the terms DUI and DWI are used interchangeably. A DUI or DWI is not a criminal offense. It is a traffic violation. Therefore, a conviction will not go on your criminal record. However, that does not mean the potential penalties of a conviction are any less severe.
In fact, New Jersey has some of the harshest DWI penalties in the country. If you are convicted of driving under the influence in Camden County, you may face penalties from the court, such as:
Keep in mind that several factors can affect potential DUI penalties. The consequences become more severe depending on any aggravating factors that apply to your case, such as a high BAC level, refusing a breath test, and subsequent offenses.
I retained Mr. Redden for a D.U.I. a few years ago. Since I travel extensively for my business, I was extremely concerned about losing my license and not being able to work. Mr. Redden made clear from the beginning that he could not guarantee I would not lose my license, but that he would do his best to save it. He delivered on that promise. Mr. Redden reviewed the evidence in my case and found a problem with the evidence. As a result, the D.U.l. was dismissed. I would recommend him to anyone.

My daughter was killed in a car accident, after being served excessive alcohol by a bar, leaving her two small children without a mother. Some people tried to say it was my daughter's fault, but Mr. Redden worked hard and was able to prove that the bar was negligent for serving her too much alcohol. He recovered money to help her children.

I was facing my second D.U.I. and a two year loss of my license. Since I also have a Commercial License that I use for work, if I was convicted of the D.U.I., I would have lost a lot of business and possibly have been destroyed financially. I had used a high-priced law firm for my first D.U.I. and was not happy with the results.
I had met Mr. Redden socially and liked his personality, knowledge of the law and his passion to win for his clients. I hired Mr. Redden - at a much lower fee than my previous lawyer - and he fought hard and got the D.U.I. charge dismissed.
I would recommend him to anyone with a legal problem, and I've referred family and friends to him.

I was asked by a close family member to loan them a significant amount of money. Due to our close family relationship, I didn't get the loan in writing, and later the other person refused to repay me. It caused an extreme financial hardship for me and my family. People told me without a written contract, I would never get paid. I hired Mr. Redden to try and get my money back. He not only got my money paid back to me, he made the other person pay his attorneys fees. He did a great job.
